1. Introduction
Welcome to PrettyMerch, a software-as-a-service (SaaS) platform provided by MerchCoders Ltd. ("we," "our," "us"), a company registered in Cyprus. These Terms and Conditions ("Terms") govern your use of our services, including the PrettyMerch Chrome extension, modile apps and web-based platform (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Definitions
- User: Any individual or entity using the Service.
- Service: The PrettyMerch Chrome extension, mobile apps and web-based platform.
- Free Version: The limited-access version of the Chrome extension available at no cost.
- Paid Version: The full-access version of the Chrome extension and the web-based platform available via subscription.
- Subscription: An agreement between you and us for paid access to the Service.
3. User Accounts
To use the Service, you must create an account by providing accurate, complete, and up-to-date information (e.g., email and password). You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities under your account.
We reserve the right to refuse service or terminate accounts if the information provided is inaccurate or misleading.
4. Services
We offer two products:
- Chrome Extension:
- Free Version: Provides limited features at no cost.
- Paid Version: Unlocks all features through a subscription.
- Web-based Platform:
- Offers a 7-day free trial with full access.
- Requires a subscription for continued use after the trial.
The Service is provided "as is" and may be updated, modified, or temporarily unavailable for maintenance. Users are permitted only one 7-day free trial account for the web-based platform. Creating multiple trial accounts is prohibited, and we reserve the right to suspend any accounts found to be in violation of this rule.
5. Free Trial and Subscription
- Free Trial: The web-based platform includes a 7-day free trial with full access. No payment is required during this period. You may cancel at any time during the trial to avoid charges.
- Subscription: After the trial, you must subscribe to continue using the web-based platform. The Chrome extension’s Paid Version also requires a subscription. Details include:
- Plans and Pricing: We offer three subscription plans for PrettyMerch:
- Pro Plan: Grants full access to the unlocked Chrome extension. Cost: $19/month or $165/year.
- Research Plan: Provides access to the web-based platform. Cost: $19/month or $165/year.
- Bundle Plan: Includes access to both the unlocked Chrome extension and the web-based platform. Cost: $29/month or $249/year.
All prices are in USD and subscriptions are billed in advance, either monthly or annually based on your choice. Prices may be changed without notice for new subscribers. For existing subscribers, we will never change the price as long as your subscription remains active. If you cancel your subscription and re-subscribe later, this will be treated as a new subscription and will follow the current prices at that time.
Promos and Discounts: We often run promotional offers and discounts. Users who subscribe during a promotional event will follow the terms specific to that event.
- Automatic Renewal: Subscriptions renew automatically unless canceled before the renewal date.
- Cancellation: You may cancel your subscription at any time; cancellation takes effect at the end of the current billing cycle.
- Immediate Cancellation and Refund: You may contact us at support@prettymerch.com to request immediate cancellation of your subscription and refund of remaining amount.
6. Payment
- Methods: We accept the following payment options:
- Credit Card
- PayPal
- Apple Pay
- Billing: Subscriptions are billed monthly or annually in advance, depending on your chosen plan.
- Authorization: You authorize us to charge your chosen payment method for the subscription fee.
- Refund Policy: Our refund policy is as follows:
- 30-Day Money-Back Guarantee: You can request a full refund within 30 days of your initial subscription purchase, no questions asked.
- After 30 Days: We offer a prorated refund for the remaining unused portion of your subscription. This applies to both monthly and annual plans.
- Processing Time: We trigger the refund immediately upon request, but it may take up to 5 business days for the bank to process the request and the funds to appear in your account.

7. User Conduct
You agree not to:
- Use the Service for illegal or unauthorized purposes.
- Attempt to gain unauthorized access to other accounts or our systems.
- Reverse engineer, decompile, or extract the Service’s source code.
- Interfere with the Service’s functionality or security.
Violations may result in suspension or termination of your account.
8. Intellectual Property
- Our Rights: The Service, including its software, design, and content, is owned by MerchCoders Ltd. and protected by intellectual property laws. You may not copy, modify, or distribute it without our written permission.
- User-Generated Content: With PrettyMerch, you can use AI to generate titles and descriptions for your products. Here’s how we handle your content:
- Ownership: You retain full rights to your content. We do not require or claim any rights to it.
- Deletion Option: You can delete your generation history at any time. Once deleted, we do not store or retain that information.
9. Data Protection and Privacy
We collect, use, and protect your personal data in accordance with our Privacy Policy and applicable laws, including the General Data Protection Regulation (GDPR). Please refer to the Privacy Policy for details.
Third-Party Integrations: We use:
- Paddle.com: This service processes our payments and manages subscriptions securely. Your payment details are handled by Paddle.com according to their terms and privacy policy.
10. Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages (e.g., loss of profits or data).
- Our total liability shall not exceed the amount you paid us in the preceding 12 months.
Uptime:
- Our Goal: We strive to provide 99%+ uptime for the Service.
- No Guarantee: While we aim for high availability, we do not offer a formal uptime guarantee.
11. Termination
- By Us: We may suspend or terminate your account for violating these Terms, non-payment, or at our discretion with notice.
- By You: You may terminate your account at any time by canceling your subscription and ceasing use of the Service.
- Effects: Upon termination, you lose access to the Service.
- Data Retention: We retain your user data for:
- 30 Days: After your account is terminated, we keep your data for 30 days in case you decide to sign up again and pick up where you left off.
- After 30 Days: All your data is permanently deleted.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of Cyprus. Any disputes will be resolved through the courts of Cyprus.
International Use:
- No Restrictions: PrettyMerch is available for use worldwide. Our Terms and Conditions apply globally, and you’re responsible for complying with your local laws.
13. Changes to Terms
We may update these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Affiliate Program
How It Works: We have an affiliate program where partners can refer users to PrettyMerch. If a referred user subscribes, the partner earns a small commission.
Impact on Users: This program does not affect you or the services we provide in any way. Your experience remains the same regardless of how you found us.
